MOUNT VERNON – Seven defendants
were sentenced today by Judge Otho Eyster in the Knox County Court of Common
Dennis Palmer, 50, of Mount Vernon,
was found guilty of Compelling Prostitution, a third-degree felony, in October
after a bench trial before Knox County Court of Common Pleas Judge Otho
Eyster.The offense involves knowingly
agreeing to pay a minor to engage in sexual activity. Palmer was sentenced to
three years of community control with 30 months in prison suspended. He is required
to register as a Tier II sex offender and will serve 90 days in jail.Palmer
will also be required to submit to a mental health assessment, drug and alcohol
monitoring, and maintain fulltime employment.
Jennifer Gaietto, 34, of
Fredericktown was sentenced for Possession of Cocaine, a fifth-degree felony.
While answering a complaint call, Ptl. Ryan Ball found Gaietto with cocaine on
her person. Gaietto will serve three years of community control with 11 months
in prison suspended. She will have to submit to drug and alcohol treatment and
monitoring, a mental health assessment, and will have her driver’s license
suspended for 6 months.
Tommy B. Nichols, 19, of Mount
Vernon, was sentenced for Discharge of a Firearm on or Near Prohibited
Premises, a third degree felony, Tampering with Evidence, a third degree
felony, and Receiving Stolen Property, a fourth degree felony. According to the
report, Nichols allegedly fired two shots from a Mount Vernon apartment window
after being involved in altercation at the local movie theater.Nichols will serve three years of community
control with 30 months in prison suspended on the first two counts, and 15
months suspended on the receiving stolen property. He received 192 days of
credit for jail time served.Nichols
must also submit to a mental health evaluations and drug and alcohol use monitoring.
Kurt T. Byers, 30, of Danville was
sentenced on a revocation of community control for a Grand Theft charge, a
felony of the fourth degree and one count of Theft, a fifth-degree felony.
Byers failed to report to his probation officer. Byers was sentenced to 11
months in prison for the theft and 15 months in prison for the grand theft; the
sentences will be served concurrently.
Tyler M. Smith, 19, of Mount
Vernon, was sentenced on a revocation of community control for Burglary. Smith
admitted to failing to report to his probation officer, using marijuana, and
failing to complete drug counseling. Smith was sentenced to 24 months in
Tyler C. Krumlauf, 28, of Mount
Vernon, was sentenced on three counts of Burglary, all third degree felonies,
two counts of Grand Theft of a Firearm, also third degree felonies, one count
of Theft, a fifth degree felony, and one count of Theft, a felony of the fourth
degree. The indictment alleges that Krumlauf stole numerous items including two
guns, an Apple computer, and jewelry from two Mount Vernon residences. Krumlauf
will serve a total of 48 months in prison.
Jeffrey L. Smith, 31, of Mount
Vernon, was sentenced for Attempted Unlawful Sexual Conduct with a Minor, a
fourth-degree felony. Smith was charged after he solicited a law enforcement
officer posing as a fifteen-year old girl to engage in sexual activity, and then
attempted to meet the purported teenager for sex. He was sentenced to 3 years
of community control with 15 months in prison suspended. He will also have to
register as a Tier II sex offender.
